Chambers and Partners yearly ask individual contributors to their appreciated Global Practice Guides. The Practice Guide on Pharmaceutical Advertising is the first edition.
– I am honored to be one of the lawyers from different jurisdictions and to contribute the Swedish section to this edition of Pharmaceutical Advertising, says Magnus Friberg.
The Practice guide describes the countries’ application of the law as well as soft law on numerous of topics including the regulatory framework, advertising for different target groups and the tricky regulations concerning gifts, hospitality and other forms of collaborations between the industry and HCPs.
In Sweden The Medicinal Products Act and the Marketing Act are the primary laws applicable to the advertising of medical products in Sweden. In addition, the Medical Products Agency (MPA) has adopted guidelines and the industry’s organization LIF – The research-based pharmaceutical industry has since long had a self-regulatory regime concerning ethical advertising as well as rules on the collaboration between the industry and HCP’s. The latter to a large part form the basis for good practice in Sweden.
