Trademarks – Harmonized examination criteria for likelihood of confusion

On the second of October, The Office for Harmonization of the Internal Market (OHIM) launched new harmonized examination criteria for likelihood of confusion when assessing non-distinction. The new examination criteria will be applied by most of the trademark offices of EU member states (except for Italy) as well as by Iceland, Norway and Turkey. With regards to Swedish law, the new criteria to a large extent resemble the routines already carried out by The Swedish Patent and Registration Office. As a result, Swedish users may experience an increased uniformity when applying for registration with OHIM or with other member states to the European Union.
